Homeowners Association Newburg Village Homeowners Association (NVHA) is an Illinois non-for-profit corporation created under the terms and conditions of the Covenants, Conditions and Restrictions (CC&Rs) as the administrative entity of the Newburg Village subdivision, which is comprised of the homes around Newburg Village Golf Course, the Rivers Edge Condos at Newburg Village, and the homes on the private drive Stone Ridge Lane. The primary purpose of the Association is to protect, preserve, and enhance the value, attractiveness and desirability of the privately- and commonly-used property of the subdivision. Any person or entity who has an ownership interest in a lot or lots is automatically a member of the Association. General Meetings of the Association are held at least annually, and Special Meetings are called as needed.
NVHA Board of Directors Newburg Village Homeowners Association is managed by a Board of Directors consisting of five lot owners. The Board meets monthly on the first Tuesday of each month at a location determined at the previous Board meeting. The location and time of each Board meeting is posted on the NVHA web site prior to each meeting. The meetings are open to the general public.
Mailboxes Newburg Village has a uniform neighborhood mailbox plan for the subdivision, requiring a specific mailbox for all residents:
Gentry All-in-One Mailbox Post Combo #GC1 (mocha-colored), which is available at Menards for a very reasonable cost.
Mailboxes are to be installed side-by-side in groups of two on the inside circle of homes, and must be located on the left-side property line as one faces the inside circle home from the street. Specific questions concerning mailbox placement can be directed to NVHA president Gary Tiffany at 332-4015.
Neighborhood Restrictions For the purposes of enhancing and protecting the value, attractiveness and desirability of the subdivision, all of the properties and lot owners are subject to certain easements, covenants, conditions and restrictions, including:
- No above-ground swimming pools shall be erected or maintained on any lot;

No satellite dish exceeding 24 inches, antenna, or similar device shall be erected or maintained on any lot;

No building shall be erected or maintained on any lot unless it is a dwelling house designed and equipped for occupancy as a private residence by a single family only (No out-buildings or storage sheds are allowed);
-
No trucks, trailers, mobile homes, campers, vans, snowmobiles, recreational vehicles, boat, inoperable vehicles, unlicensed vehicles or horse carriers, or similar vehicles and accessories may be kept on any lot unless they are fully enclosed within the garage located on said lot;

No automobile or other motor vehicle shall be parked or placed on any portion of a lot other than a driveway or within a garage located on such lot;

No fences shall be erected or maintained until or unless plans and specifications have been submitted and approved in writing by the NVHA Architectural Committee. Any such fence shall be of a high quality wood, stained or painted on both sides, and of a height not greater than five (5) feet;

Any lot adjacent to a golf course fairway may landscape that portion of the lot adjacent to a fairway, but plans for the landscaping must be approved in advance by the NVHA Grounds Committee. Care must be exercised in the design of any landscaping along a fairway to insure that the landscaping, once mature, will not encroach on the golf course;

No netting, screening material, or other artificial barriers shall be erected on any lot, whether adjacent to the golf course or any other area of the Subdivision.

Parking The Board has set the following additional parking regulations for the neighborhood to help promote a neat, clean-looking neighborhood appearance that enhances the value of our properties:
- Residents shall utilize their garages to park their vehicles whenever possible (at least two vehicles).
- Residents may park extra vehicles on their driveways only if they are in running order, in regular use, and do not block the sidewalk.
- Guest vehicles, including cars and pick-up trucks (smaller than Ύ ton), may be parked upon the driveway for no more than 48 hours.
- Passenger vehicles may not be parked on the street in front of a residence for more than 20 consecutive hours on one side of a municipal street in the same block.
- Vehicles parked on the street are not to be parked within 15 feet of a fire hydrant, in front of mail boxes, or in front of a driveway where the parked vehicle would prevent another homeowner from entering or exiting their lot.
- Vehicles parked on the street must be parked in the proper direction on the street (as the traffic flows).
- Commercial vehicles (trucks, vans, or other vehicles commonly used for commercial purposes and/or having advertising displayed on the exterior of the vehicle) may not be parked in the subdivision except if they are a passenger-type automobile, van or pickup truck, or if they are parked within an enclosed garage.
- Commercial vehicles engaged in the delivery or pickup of goods or services (i.e., FedEx, UPS, or other delivery vans or moving vans) may park on the street provided they do not remain in excess of the reasonable period of time required to perform such commercial function.
- Vehicles belonging to or used by a contractor employed by a lot owner or an agent of the lot owner for a specific repair, renovation, or improvement to the lot or buildings thereon, are allowed during such repair or renovation.
- Emergency vehicles are not considered commercial vehicles.
- Any vehicle, boat, or trailer may temporarily be parked upon your driveway for routine servicing and repair, as long as the servicing and repair is completed within 36 consecutive hours.
- Boats, motor homes, and other recreational vehicles may be parked on your driveway (not blocking the sidewalk) for up to 48 hours to allow cleaning, loading, and maintenance. At all other times, they must be stored either out of sight within the garage or at off-site storage.
- Any accessories for vehicles, such as trailers, plows, etc., are not permitted to be left or stored on any driveway. They must be kept either out of sight within the garage or at off-site storage.
Assessments NVHA levies two annual assessments each year the Annual Association Assessment and the Sewer System Sinking Fund Assessment. The Annual Association Assessment is used exclusively to promote the health, safety, welfare, and recreation of the residents in the subdivision and for the improvement and maintenance of the Common Areas situated within the Subdivision. Each year, the Board estimates the total amount necessary to pay the Association operating costs, materials, insurance, services and supplies which will be required during the ensuing calendar year for the rendering of all services, together with a reasonable amount necessary for a reserve for contingencies and replacements. The Annual Association Assessment for 2007 is $125.00 per lot for lots around the golf course.
The Sewer System Maintenance Fund Assessment is used to establish and maintain a sinking fund for purposes of repair, reconstruction and replacement of the sewage disposal system owned by the Subdivision in accordance with its Agreement with Rock River Water Reclamation District. The Sewer System Maintenance Fund Assessment for 2007 is $75.00 per lot for lots around the golf course.
Assessments are due and payable on January 1 of each year in an annual installment. Any assessment not paid within thirty (30) days after the due date will be deemed in default and will bear interest from the due date at the rate of ten percent (10%) per year. NVHA may bring an action at law against the lot owner personally obligated to pay, or may foreclose a lien against the property. No lot owner may waive or otherwise escape liability for the assessments by non-use of the common area or abandonment of the specified lot.
Golf Course Privileges No golf playing privileges are included in the ownership of a lot at Newburg Village and no lot owner has direct access to the golf course. However, the golf course does offer special rates for residents. Please check with the golf course clubhouse (332-9002) for an explanation of the current arrangement.
Damage from Golf Balls Homes and landscaping may, from time to time, be in the path of errant golf shots, causing damage and/or requiring retrieval of golf balls. Golfers have a temporary easement over each and every lot specifically for the retrieval of golf balls. NVHA, the manager of the golf course, and the owners of the golf course are not liable for any damage that results from an errant golf ball. However, if the offending golfer can be identified, you may be able to recover any damages under his or her homeowners liability coverage. The Clubhouse will be happy to help identify offending golfers.
Garbage Service Because Newburg Village is located within the village limits of Cherry Valley, garbage service is handled through the Village and is provided by Rock River Disposal. Residential garbage collection is on Tuesday. Residents are allowed two garbage bags or two containers not exceeding 30 gallons each with a 50 pound weight limit at the curb for collection each week. If residents desire to put out additional bags or containers, they may purchase stickers at the Cherry Valley Village Hall (cash only, no checks) 806 East State Street or the Shell Express Lane gas station in downtown Cherry Valley. Sticker costs: Additional garbage - $1.00 each
Recycling Information There is unlimited collection of recyclables, picked up each week on Tuesdays. Recycling bins are available at the Village Hall. The cost is $6.00. The recyclables should be placed at the edge of the curb. Allowable recycled items include envelopes, junk mail, magazines, newspaper & inserts (please place all paper items in paper bags BEFORE placing in recycling bin); hard cover books; phone books & catalogs; grocery bags; corrugated cardboard (in sections of 3 foot by 3 foot or smaller); cereal boxes (with liner removed); clear, brown & green glass bottles & jars; plastic containers marked with the symbol #1 thru #7 (please make sure they are clean!); and aluminum, steel and bi-metal cans. All glass, plastic, and cans may be mixed loose in bins, or separated in paper bags and placed in the bin.
Lawn waste is also picked up from April through November and should be placed either in paper lawn bags (available at most home improvement, grocery, and hardware stores) or in a garbage container permanently marked with an "X" to indicate lawn waste.

Our polling place is Belvidere 17, which is located at the Boone County Conservation District, 630 Appleton Rd., Belvidere. Take Newburg Road east toward Belvidere to Appleton Road, turn left and follow Appleton Road around the "S" curve. The Boone County Conservation District will be located on your left.
